Welcome to Chibify, an AI-powered platform that transforms your photos into adorable chibi-style artwork. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Chibify provides users with an AI-powered photo-to-chibi transformation service. You may upload photos and select from various chibi art styles (Gashapon, 2D Chibi, Funko Pop) to generate custom chibi artwork. You agree to use the service in accordance with all applicable laws and regulations.

User Accounts and Registration

1. Account Creation: To use Chibify's generation features, you need to sign in via Google or GitHub OAuth. You must provide accurate information during the sign-in process.

2. Account Security: You are responsible for maintaining the security of your account and for all activities that occur under your account.

3. Credits System: Chibify operates on a credits-based system. Each chibi generation consumes one credit. Free users receive a limited number of daily credits, while paid subscribers receive monthly credit allocations.

Content and Intellectual Property Rights

• Your Content: You retain ownership of the photos you upload. By uploading a photo, you grant Chibify a limited license to process it for chibi art generation.
• Generated Artwork: Chibi artwork generated by Chibify may be used by you for personal or commercial purposes according to your subscription plan.
• Platform IP: The Chibify platform, its design, code, and AI processing pipeline are the intellectual property of Chibify and are protected under copyright law.

Acceptable Use

You agree not to:

• Upload content that infringes on others' intellectual property or privacy rights
• Upload illegal, harmful, or offensive content
• Attempt to reverse-engineer or exploit the AI generation system
• Use automated tools to mass-generate content beyond your plan's limits
• Interfere with or disrupt the security or performance of the service
• Share or resell your account credentials

Privacy and Data Collection

Chibify collects account information, uploaded images, usage data, device information, cookies, and payment details (via Stripe). For full details, please refer to our Privacy Policy.

Pricing and Payments

• Chibify offers Free, Pro ($9.9/month), and Business ($29.9/month) plans
• All purchases are processed securely through Stripe
• Subscription payments are recurring and will auto-renew unless canceled
• Unused credits do not roll over to the next billing period
• Refunds may be considered on a case-by-case basis within 7 days of purchase

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your unused credits will be forfeited.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. AI-generated artwork quality may vary. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Chibify shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including but not limited to loss of data or unsatisfactory AI-generated results.

Indemnification

You agree to indemnify and hold harmless Chibify, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
